2. Description of Service

What SoulWhisp Is

SoulWhisp is an AI-powered listening service designed to give people a safe space to practise saying the things they can't say anywhere else.

SoulWhisp provides:

• - Anonymous, private conversations with an AI listener
• - Reflection and emotional support
• - A space to express thoughts without judgment
• - Gentle questions to help you hear yourself and find your own words

Think of it as a practice conversation -- a space to get things off your chest, untangle what you're feeling, and build the confidence to have the real conversation when you're ready -- with a counsellor, a friend, a helpline, or anyone you trust.

SoulWhisp is built on:

• - Real crisis listening principles
• - Active listening techniques
• - Non-judgmental presence methods
• - Principles learned from years of volunteer listening work

What SoulWhisp Is NOT

SoulWhisp is not:

• - Therapy or psychological treatment
• - Medical advice or diagnosis
• - Crisis intervention or emergency services
• - A replacement for professional mental health care
• - A replacement for human connection
• - Monitored by humans or mental health professionals

SoulWhisp cannot:

• - Diagnose mental health conditions
• - Prescribe treatment or medication
• - Provide emergency intervention
• - Contact authorities or emergency services on your behalf
• - Track your location or identify you
• - Store or remember previous conversations

3. Acceptable Use Policy

Purpose of SoulWhisp

SoulWhisp is designed for anyone who needs a space to say something out loud but doesn't have anyone to say it to right now. That includes people experiencing:

• - Suicidal thoughts
• - Self-harm urges
• - Depression or anxiety
• - Addiction struggles
• - Trauma and abuse
• - Guilt or shame
• - Isolation and loneliness
• - Any form of emotional distress

You don't need to be in crisis to use SoulWhisp. You just need a space to practise putting your feelings into words.

This is not a general-purpose chatbot or entertainment service.

Prohibited Uses

You may NOT use SoulWhisp for:

Sexual or Romantic Content

• - Sexual conversations of any kind
• - Romantic or flirtatious interaction
• - Sexually explicit requests or roleplay
• - Requests for intimate or sexual advice
• - Any sexual content involving minors (will be reported to authorities)

Why: SoulWhisp is a listening service, not a companion bot or dating service.

Entertainment or Gaming the AI

• - "Jailbreaking" or trying to bypass AI safety features
• - Testing how the AI responds to unusual inputs
• - Trying to make the AI say inappropriate things
• - Using it as entertainment or for laughs
• - Sharing "funny" AI responses on social media
• - Attempting to manipulate the AI

Why: This wastes limited resources and degrades the service for people who need it.

Spam & Automation

• - Automated bot interactions
• - Sending rapid-fire meaningless messages
• - Advertising or promotional content
• - Marketing or commercial use
• - Spam of any kind
• - Mass automated testing

Why: This overloads the system and prevents genuine users from accessing it.

Abusive Behaviour

• - Harassment directed at the AI
• - Extreme profanity or verbal abuse (beyond expressing genuine pain)
• - Deliberately trying to "break" or crash the system
• - Malicious use of any kind
• - Attempts to compromise security
• - Denial of service attacks

Unrelated Purposes

• - Homework help or academic assistance
• - General information requests or research
• - Casual conversation or small talk
• - Philosophical debates
• - Creative writing assistance
• - Jokes or entertainment
• - Any use unrelated to genuine emotional support

Illegal Activity

• - Planning or discussing illegal acts
• - Threats of violence or terrorism
• - Child exploitation of any kind
• - Any activity that violates applicable laws

Illegal activity will be reported to appropriate authorities.

4. How We Detect Misuse

Technical Pattern Monitoring

We use technical patterns to detect misuse without reading your conversations:

Red flags we monitor:

• - Extremely rapid message frequency (suggesting spam or bots)
• - Very short sessions repeated many times (suggesting testing)
• - Automated bot-like patterns
• - Unusual usage times or frequencies
• - IP addresses associated with previous abuse

What we DON'T monitor:

• - The actual content of your messages
• - What you're saying to the AI
• - Your specific words or topics discussed

We detect misuse through behaviour patterns, not content surveillance.

5. Consequences of Misuse

First Instance / Minor Misuse

• - Warning message in the chat
• - Temporary CAPTCHA verification
• - Rate limiting (slower response times)
• - Temporary cooldown period

Repeated or Serious Misuse

• - Temporary IP block (24-72 hours)
• - Extended IP block (7-30 days)
• - Permanent IP block
• - Account termination (if accounts exist in future)

Severe Violations (Immediate Permanent Ban)

• - Sexual content involving minors
• - Credible threats of violence or terrorism
• - Illegal activity
• - Deliberate attempts to harm or destroy the service
• - Coordinated abuse attacks

Legal Action

For serious violations involving illegal activity, we will:

• - Preserve technical logs as required
• - Report to appropriate law enforcement
• - Cooperate fully with legal authorities
• - Provide IP addresses and access logs (but not conversation content, which doesn't exist)

6. False Positives & Appeals

If You're Blocked in Error

Our abuse detection looks at technical patterns only. Sometimes genuine users may trigger false positives, especially if:

• - You're on a shared network or VPN
• - Your internet connection is unstable (causing rapid reconnects)
• - Multiple people use the same public IP

To appeal a block:

Include:

• - Approximate date and time you were blocked
• - What you were doing when blocked (general description)
• - Your IP address (if known)
• - Any other relevant technical details

We will review and respond within 48 hours.

If the block was in error, we'll restore access immediately and apologise for the inconvenience.

7. Emergency Situations

SoulWhisp Cannot Handle Emergencies

SoulWhisp cannot:

• - Contact emergency services for you
• - Track your location
• - Identify who you are
• - Send help to you
• - Intervene in a crisis

What SoulWhisp does when you express immediate danger:

• - Gently suggests contacting professional help
• - Provides crisis hotline numbers
• - Stays present with you while you decide what to do
• - Does not abandon you or force any action

We will not:

• - Call authorities without your knowledge (we cannot)
• - Force you to seek help
• - Make decisions for you
• - Track or identify you

8. Privacy & Data

What We Collect and Don't Collect

We do NOT collect:

• - Your name or identity
• - Email address (unless you donate)
• - Phone number
• - Location data
• - Conversation history (deleted immediately)

9. Disclaimers & Limitations of Liability

No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

• - That the AI will provide helpful or accurate responses
• - That the service will meet your specific needs
• - That the service is error-free or secure
• - That your situation will improve from using the service

Not Professional Advice

SOULWHISP DOES NOT PROVIDE:

• - Medical advice, diagnosis, or treatment
• - Psychological or psychiatric services
• - Licensed therapy or counselling
• - Crisis intervention services
• - Emergency response

Any information provided by SoulWhisp is for reflection purposes only and should not be considered professional advice. SoulWhisp is a practice space -- it helps you find your words, not replace professional support.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SoulWhisp and its operators shall not be liable for:

• - Any harm resulting from use of the service
• - Decisions made based on AI responses
• - Technical failures or service interruptions
• - Loss of data (conversations are not stored)
• - Any direct, indirect, incidental, or consequential damages

You use SoulWhisp at your own risk.

Indemnification

You agree to indemnify and hold harmless SoulWhisp, its operators, and affiliates from any claims, damages, or expenses arising from:

10. Service Availability

No Guarantee of Uptime

SoulWhisp is provided for free and we do our best to keep it available 24/7.

However, we do not guarantee:

• - That the service will be available at any specific time
• - That the service will never experience technical issues

We may:

• - Temporarily suspend service for maintenance
• - Experience unexpected outages
• - Limit access during high traffic
• - Make the service unavailable in certain regions

Right to Modify or Discontinue

• - Discontinue the service entirely

We will provide notice when possible, but are not obligated to do so.

11. Intellectual Property

Our Property

All content, code, design, trademarks, and materials related to SoulWhisp are owned by ZoovaTech or its licensors.

You may not:

• - Copy, modify, or distribute our code or content
• - Use our name, logo, or branding without permission
• - Create derivative works based on SoulWhisp
• - Reverse engineer the service
• - Scrape or systematically collect data from the service

Your Content

You retain ownership of anything you say to SoulWhisp.

However:

• - Your conversations are immediately deleted and not stored
• - We cannot retrieve or provide copies of your conversations
• - You have no right to demand conversation transcripts (they don't exist)

12. Third-Party Services

SoulWhisp relies on third-party services:

Stripe (Donations):

• - Subject to Stripe's terms and privacy policy
• - We are not responsible for Stripe's processing

OpenAI (AI Processing):

• - Conversations are processed by OpenAI's API
• - Subject to OpenAI's terms and privacy policy
• - OpenAI does not store your conversations

Vercel (Hosting):

• - Subject to Vercel's terms and conditions

You agree that:

• - These third parties have their own terms and policies
• - We are not responsible for their actions or failures
• - Their services may change or become unavailable

13. Age Requirements

Minimum age: You must be at least 13 years old to use SoulWhisp.

Ages 13-17: You may use the service, but we recommend parental awareness.

Under 13: If you are under 13, you may not use this service.

We do not verify age.

By using the service, you represent that you meet the age requirement.

14. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles.

Disputes: Any disputes arising from these Terms or your use of SoulWhisp shall be resolved in the courts of Romania.

15. Changes to These Terms

We May Update These Terms

We reserve the right to modify these Terms at any time.

How we'll notify you:

• - Prominent notice on the website for major changes
• - Email notification (if we have your email from donations)

Your continued use of SoulWhisp after changes means you accept the updated Terms.

If you don't agree with changes, please stop using the service.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the rest of these Terms remain in full force and effect.

17. Entire Agreement

20. Final Note

SoulWhisp exists to give people a safe space to practise saying the things they can't say anywhere else -- and to help them find the confidence to say those things to a real person when they're ready.

We ask that you honour that purpose by using it appropriately.
